The IEP or Individualized education program is the conditioned statement that says how to identify children’s needs and how to implement their learning objectives under the Individuals of Disability Education Act of 1990. So, any corruption that occurs against the IEP standards is known as an IEP violation. The IEP violations are basically two kinds. Those are the substantive IEP violations and procedural IEP violations. The substantive means the violations that occur due to holes in standard IEP content establishment. And, procedural violations are basically linked to the failure of a particular school or education institute to meet IEP commitments. So, the examples of IEP violations related to both these aspects are as follows.

7 Examples of IEP Violation under Substantive Violations

The possible violations under IEP policy corruption in relation to the education of children with disabilities are as follows.

Failure in administrating and evaluating the student needs 

Every student is unique and has their skills. So, the learning requirements are differing as with those skill levels and learning objectives. In case the educators fail to identify those key points through a successful evaluation, it is known as a violation of IEP policy.

Failure in assessing the student’s requirements in both academic and functional aspects

The IEP says that the educator should always consider students’ need to establish happy learning and healthy functionalities. But, if the school does not succeed in achieving this objective even if there are preventive measures, it is known as a violation.

The misuse of the “SMART” principle in goal setting 

The goals or objectives that apply to student learning requirements should always be specific, measurable, attainable, realistic and time-bound. This kind of scientifically developed goal always enhances students’ ambitions to meet those challenging outcomes. But, failure in using this principle appropriately may harm their future. So, this is also known as a violation of policy.

The unsuccessful development of annual objectives for learning and studying purposes

The Institute should finalise annual goals in order to meet student needs. But, failure to come across the annual goals is known as a corruption of IEP obligations and thus it is known as a violation.

Inability to apply special education needs for the targeted group of students

When it comes to students with disabilities, their needs and requirements are different from each other. Thus, the school should take all the measures to apply special education strategies through the recent updates of peer-reviewed research projects. If the school anabel to perform this due to lack of intention, it is known as an IEP violation.

Failure to make changes to the education systems and teaching strategies when needed based on the student progress and requirements

If the institute has enough measures to evaluate students’ progress, they can make changes to the learning and teaching methods to deliver a more meaningful education. So, if the school fail to implement those changes at the appropriate time, it is again a policy violation.

Failure in following PLAAFP is related to all the student’s performances

The PLAAFP is known as the Present Level of Academic Achievement and Functional Performances scale. Whenever the school is not succeeded to classify all the children’s performances under PLAAFP, it is also known as an IEP violation.

The failure in adherence to alternative placement as continuum measures and the inability to implement the required material policies under IEP is also the IEP violations.

5 Examples of IEP Violation under Procedural Violations

The corruption of IEP policy with the missing procedural compartment such as the participation of necessary parties are known as procedural violations and a few examples of such situations are described here.

Failure in getting the participation of parents of children with disabilities in policy development

The child and parent are one of the major parties in the special education program. So, whenever there is a need for their participation the committee should always call them for their points to succeed in the process. That is the only way to identify their requirements, difficulties and challenges.

Failure in distributing notices related to changes in IEP among parents and children when needed

Whenever there is any need for changing the IEP policy it directly affects children with disabilities. So, the team should take immediate action to pass this message to parents and children. Especially, educating the parents regarding those changes is important. Similarly, the children also have the right to know about those changes unless they are out of the capacity to identify. Anyways, the team should take responsibility to educate children within their capacities about the policy changes that can affect their education.

Inability to contact all the required parties for the IEP team

The policy-making for IEP is not an easy task and it is something closely related to the concepts of teaching and learning with human factors of children with disabilities. Thus, teamwork is very much important for a standard set of policies. In case the team miss at least one composition of the team, it will be a massive fault in outcome measures. Thus, failing in getting the involvement of all the unique parties is considered an IEP violation.

Failure in implementing the IEP policy in practical settings

Even though there are an array of policies to make sure the rights of children with disabilities under IEP policies if the team fail to use those in the practical units, it is known as a violation.

Failure in making records and issuing records when needed

The records of the children’s progress are an essential measure for the team of education and also for the parents. In case the team fail to provide those records within 45 days of request is considered a violation of the policies.

The verdict

IEP violations basically can be categorised into two subsets substantive and procedural. Both these violations are supposed to prevent to ensure children’s rights in education as they are the special needs with the underline disabilities. Identifying the examples of IEP violations under both these subsets will help the team to maintain better communication with the team members.
